Studio Sante Gift Cards Regulations

I. General Information

Valid from 17.06.2022

  1. These Regulations define the rules and conditions of sale of Gift Cards in the online store Studio Sante Uzdrowisko Miejskie by Sante sp. z o.o. with its registered office in Warsaw.
  2. The content of the Regulations is available on the Studio Sante website at www.studiosante.pl/regulaminy, in a form that allows it to be saved and printed, and at the reception of Studio Sante Uzdrowisko Miejskie in order to ensure the possibility of familiarizing oneself with its content before concluding the contract.
    Definitions:

    • Seller – this refers to the company Sante sp. z o.o. with its registered office in Warsaw at ul. Jagiellońska 55A, KRS number 0000950564, NIP 524-10-06-610, REGON 010827252, which, acting in its own name and on its own account, sells Gift Cards.
    • Buyer – this refers to a natural person with at least limited legal capacity and at least 18 years of age, as well as a legal person or an organizational unit without legal personality, to which the law grants legal capacity, which purchases a Gift Card for a specified amount of money.
    • Card Holder – Buyer or person who presents the Gift Card for the purpose of its redemption,
    • Store – this refers to the online store run by the Seller at the internet address sklep.studiosante.pl,
    • Order – Buyer’s declaration of intent submitted using the Order form and aiming directly at concluding the Gift Card Sales Agreement with the Seller,
    • Order Form – interactive form available in the Store enabling the placement of an Order, in particular by specifying the value of the Gift Card and the method of delivery and payment,
    • Gift Card – an identification mark issued to the bearer, containing a specific serial number entitling to use the services of Studio Sante Uzdrowisko Miejskie with its registered office in Warsaw (03-301) at ul. Jagiellońska 55A in accordance with the applicable price list and the value of the Gift Card held.
    • Services – this means the services offered by the Seller in Studio Sante Uzdrowisko Miejskie in the offer available on the website www.studiosante.pl
    •  Distance contract – a contract concluded with a consumer as part of an organized distance contracting system, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication until the conclusion of the contract, which is regulated by the Act of 30.05.2014 on consumer rights (consolidated text: Journal of Laws 2017, item 683, as amended)

II. Terms and conditions for purchasing gift cards

  1. In order to place an Order and purchase a Gift Card by the Buyer, Internet access, an active e-mail account and a contact telephone number are required.
  2. The Buyer can place an Order and purchase a Gift Card by registering in the Store and creating an account or by providing the necessary personal and address data enabling the execution of the Order without creating an Account. Registration in the Store does not constitute an obligation to make a purchase. Registration is done once. Subsequent purchases are made by logging into the account created by them by providing a login (e-mail) and password.
  3. In the event of creating an account in the Store, the Buyer is obliged to keep the password to the account secret. The Buyer is obliged to exercise the utmost diligence to prevent the loss of the access password or its possession by third parties (regardless of the method). The Buyer is solely responsible for providing the login and password to third parties.
  4. The Buyer may delete their account at any time. Deleting the account results in the permanent and irreversible deletion of all Buyer’s data from the online system of the Store. The Buyer may send the above-mentioned request to the e-mail address sklep@studiosante.pl
  5. Making purchases in the Store is related to the correct completion of the Order Form, in particular by providing the personal data required in the Order Form, contact number, e-mail address, expressing consent to the conclusion of a sales contract and a declaration of familiarization with the Regulations.
  6. Orders can be placed 24 hours a day, 7 days a week, all year round, excluding periods of technical breaks specified in the information message posted on the Store’s website.
  7. If the Seller has any doubts as to the identity of the Buyer or the Order placed, the Seller reserves the right to additionally verify the Buyer’s data, e.g. by telephone.
  8. The Buyer may use the following payment methods:
    • online payment using the PayU payment system, whereby if the payment is made on Friday by 1:00 p.m., the Gift Card will be sent by courier on the same day, but delivery will take place on the next business day or collection will be possible at the Studio Sante reception.
    • in the form of prepayment (transfer) – to the seller’s account indicated in the order. When choosing the payment method by transfer, payment should be made within 5 business days to the bank account indicated in the e-mail confirming the placed Order, otherwise the Order will be canceled. If the payment is made on Friday by 1:00 p.m., the Gift Card will be sent by courier on the next business day after the money is credited to the Studio Sante account or collection will be possible at the Studio Sante reception.
    • payment in cash or by card upon personal collection at the Studio Sante Uzdrowisko Miejskie reception.
  9. The Buyer may use the following methods of delivery or collection of the Gift Card:
    • Courier delivery,
    • Personal collection at the reception of Studio Sante Uzdrowisko Miejskie.
  10. The Seller has the right to refuse to process the Order if:
    • The Order was placed on an incorrectly completed Order Form,
    • The Order was placed in violation of these Regulations.
  11. After making the payment, the Buyer will receive a confirmation in the form of an email message, which will be sent to the email address provided when placing the Order.

III. Gift Card and Services

  1. The Gift Card is issued in the form of an elegant card packed in a decorative Envelope.
  2. The Gift Card is valid for a period of 12 months from the date of purchase. After the indicated period and unused in whole or in part, the value of the Gift Card is lost.
  3. The Gift Card is for any amount selected by the customer, but not less than PLN 100.
  4. The Gift Card can be used during one or several visits, depending on the value of the selected Services.
  5. The Gift Card is not refundable or exchangeable for cash. It is also not possible to give change in cash from the Gift Card, which amounts to an amount higher than the value of the Services used.
  6. In accordance with the wish, the Holder of the Gift Card may pay extra to the Gift Card if the value of the Services they wish to use amounts to an amount higher than the value of the Gift Card.
  7. Gift Cards entitle the holder to use any selected Services from the offer of Studio Sante Uzdrowisko Miejskie.
  8. In the event of loss or destruction of the Gift Card, the Seller shall not be liable or compensate for the loss caused by the situation.
  9. The Gift Card can be purchased at the reception desk at Studio Sante Uzdrowisko Miejskie. The purchase of Gift Cards at Studio Sante Uzdrowisko Miejskie does not involve any additional fees.
  10. In order to agree on the date of the Service (except for the Sauna and Pool Service), please contact the reception desk in advance at tel. no. 22 417 80 90, e-mail: kontakt@studiosante.pl
  11. When making a reservation, please inform the reception desk that the form of payment for the arranged Service will be the Gift Card.
  12. The Gift Card must be presented at the reception desk of Studio Sante Uzdrowisko Miejskie before using the Service.
  13. When paying via the PayU system or by bank transfer for the purchase of a Gift Card, a reservation for a Service within the Gift Card can be made only after the payment has been credited to the Seller’s account.
  14. The prices of Services given in the Store are gross prices – including the necessary VAT.
  15. The Seller reserves the right to change the prices of Services in the Store’s offer, introduce new Services to the Store’s offer, conduct and cancel promotional campaigns on the Store’s websites or introduce changes to them. The above rights do not affect the prices of ordered Services placed before the date of entry into force of the price change, terms of promotional campaigns or sales.

IV. Right to withdraw from the contract

  1. In accordance with the Act of 30 May 2014 on consumer rights (consolidated text: Journal of Laws 2017.683, as amended), the Buyer who is a consumer within the meaning of Art. 221 of the Civil Code has the right to withdraw from the distance sales contract within 14 calendar days from the date of conclusion of the sales contract, i.e. from the date of confirmation of the Order by the Buyer. To meet the deadline, it is sufficient to send the declaration before the deadline expires.
  2. Withdrawal is made via e-mail to the address: sklep@studiosante.pl The declaration can also be submitted on the form, the template of which is Annex No. 1 to these Regulations and Annex to the Act of 30 May 2014 on consumer rights, however, this is not obligatory.
  3. The Seller shall immediately send the Consumer confirmation of receipt of the declaration of will to withdraw from the sales contract, to the e-mail address indicated by the consumer, with information about blocking the amount on the Gift Card.
  4. The Seller shall promptly, but no later than within 14 days of receiving the Consumer’s declaration of withdrawal from the agreement, return to the Consumer all payments made by him/her for the ordered card.
  5. The payment shall be returned using the method of payment used by the Consumer, unless the Consumer has expressly agreed to another method of return that does not involve any costs for him/her.
  6. The Seller may withhold the return of the payment until the Gift Card is received back or until proof of its return is provided to him/her, depending on which event occurs first.
  7. The Consumer should return the Gift Card to the Seller’s address provided in these Regulations promptly, no later than 14 days from the day on which he/she informed the Seller of the withdrawal from the Agreement. The deadline will be met if the Buyer returns the Gift Card before the expiry of the 14-day period.
  8. The Consumer bears the direct costs of returning the Gift Card.
  9. The right to withdraw from a contract concluded outside the business premises or at a distance does not apply to the Consumer in relation to contracts for the provision of services if the Seller has fully performed the Service with the Consumer’s express consent before the expiry of the 14-day period for withdrawal from the contract.

V. Complaints

  1. The Buyer has the right to file complaints regarding Gift Cards.
  2. The complaint should be filed immediately after noticing the defect in the Gift Card.
  3. Complaints should be filed in writing at the reception desk of Studio Sante or by e-mail to sklep@studiosante.pl.
  4. When filing a complaint, the Buyer should provide their contact details (name and surname, e-mail address and phone number), as well as a detailed description of the identified problem and their request.
  5. The complaint will be considered by the Seller within 14 days from the date of its receipt from the Buyer. The Buyer will be informed about the method of handling the complaint by e-mail.
  6. If the buyer is a consumer, any disputes arising from the regulations or sales agreements may be resolved through mediation (more information can be found here: https://uokik.gov.pl/wazne_adresy.php#faq595) or via the ODR online platform. In accordance with the provisions of art. 14 Regulation (EC) No 524/2013 of the European Parliament and of the Council of 21 May 2013. VI. Personal data protection

In accordance with art. 13 sec. 1 and sec. 2 of the general regulation on the protection of personal data of 27 April 2016 (hereinafter referred to as GDPR), we inform you that:

  1. The administrator of your (Buyer’s) personal data is the Seller (Sante sp. z o.o.) with its registered office in Warsaw (03-301), at ul. Jagiellońska 55A, registered in the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division under KRS number 0000950564, NIP: 5241006610, REGON: 010827252).
  2. The Seller, as the administrator, has appointed a Personal Data Inspector, who can be contacted by e-mail: iod@sante.pl
  3. The Buyer’s personal data will be processed for the purpose of implementing the subject of the contract on the basis of art. 6 sec. 1 lit. b GDPR.
  4. The recipient of the Buyer’s personal data will be the partners and employees of the Seller within the scope of their official duties based on authorization.
  5. The Buyer’s personal data will not be transferred to a third country/organization;
  6. The Buyer’s personal data will be stored until the end of cooperation.
  7. The Buyer has the right to access the content of their data and the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to transfer data.
  8. The Buyer has the right to file a complaint to the supervisory body – the Office for Personal Data Protection, if they consider that the processing of the Buyer’s personal data violates the provisions of the general regulation on the protection of personal data of April 27, 2016;
  9. The provision of personal data by the Buyer is voluntary, but necessary for the implementation of the subject of the contract.

VII. Final provisions

  1. The terms of the sales agreement are specified in these Regulations, applicable legal provisions and individual arrangements between the Seller and the Buyer.
  2. In matters not regulated in these Regulations, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of services by electronic means; the Act on consumer rights, the Act on the protection of personal data
  3. The court with jurisdiction to hear any disputes that may arise as a result of the execution of the provisions of these Regulations is the court with jurisdiction for the consumer’s place of residence. In the event that the Buyer is not a consumer – the competent court will be determined based on the provisions of the Code of Civil Procedure.
  4. The Seller is entitled to introduce changes to the Regulations with future effect. The changes may not violate the Buyer’s rights resulting from Orders placed before the changes were introduced.
  5. Direct contact between the Buyer and the Seller is possible using the form on the Store’s website or by phone at the number provided in the e-mail received after placing the Order.
