Privacy and Cookies Policy

This Cookies Policy defines the rules for storing and accessing information on the User’s devices using Cookies, used to provide services provided electronically requested by the User, by Sante Sp. z o.o. (formerly: Sante A. Kowalski Sp. j.) with its registered office in Warsaw.
In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation “GDPR”), we inform you about the principles of processing your personal data collected when using the website https://www.studiosante.pl and https://www.sklep.studiosante.pl.

I. Definitions:

Administrator – refers Sante Sp. z o.o. (formerly: Sante A. Kowalski Sp. j.) with its registered office in Warsaw at ul. Jagiellońska 55A, entered into the register of entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Register under KRS number 0000050433, NIP 524-10-06-610, REGON 010827252, which provides services electronically and stores and gains access to information on the User’s devices.

Cookies – refers computer data, in particular small text files, saved and stored on devices through which the User uses the Service’s websites.

Administrator’s Cookies – refers Cookies placed by the Administrator, related to the provision of electronic services by the Administrator via the Service.

External Cookies – refers Cookies placed by the Administrator’s partners, via the Service’s website.

Service – refers the website or application under which the Administrator runs the website, operating under the domain https://www.studiosante.pl and https://www.sklep.studiosante.pl

Device – refers the electronic device through which the User gains access to the Service.

User – refers the entity for which, in accordance with the Regulations and legal regulations, services may be provided electronically or with which an Agreement for the provision of services electronically may be concluded.

Customer – an entity, a natural person with full legal capacity, and in cases specified in the provisions of law also a person with limited legal capacity, a legal person or an organizational unit to which the Civil Code grants legal capacity using the Electronic Services provided by the Service Provider, including in particular one who has concluded or intends to conclude a Sales Agreement with the Seller via the Store or wants to use or uses other services of the Administrator.

Goods – products available in the Store (movable items) that are or may be the subject of the Order;

II. Types of Cookies Used

The Cookies used by the Administrator are safe for the User’s Device. In particular, it is not possible for viruses or other unwanted software or malware to get into the User’s Devices this way. These files allow you to identify the software used by the User and customize the Service individually for each User. Cookies usually contain the name of the domain they come from, the time they are stored on the Device and the assigned value.
The Administrator uses two types of cookies:

  • Session cookies: they are stored on the User’s Device and remain there until the end of the browser session. The saved information is then permanently deleted from the Device’s memory. The session cookie mechanism does not allow for the collection of any personal data or any confidential information from the User’s Device.
  • Persistent cookies: they are stored on the User’s Device and remain there until they are deleted. Ending a given browser session or turning off the Device does not delete them from the User’s Device. The persistent cookie mechanism does not allow for downloading any personal data or any confidential information from the User’s Device.

The User has the option to limit or disable access of cookies to their Device. In the case of using this option, the use of the Service will be possible, except for functions that by their nature require cookies.

III. Purposes for which Cookies are used

The Administrator uses Own Cookies for the following purposes:

  • service configuration, adapting the content of the Service’s web pages to the User’s preferences and optimizing the use of the Service’s web pages;
  • recognizing the Service User’s device and its location and appropriately displaying the web page, adapted to their individual needs;
  • remembering the settings selected by the User and personalizing the User’s interface, e.g. in terms of the selected language or region from which the User comes;
  • remembering the history of visited pages on the service in order to recommend content; font size, appearance of the web page, etc.
  • user authentication on the service and ensuring the user’s session on the service, maintaining the Service User’s session (after logging in), thanks to which the User does not have to re-enter the login and password on each subpage of the Service;
  • correct configuration of selected Service functions, enabling in particular verification of the authenticity of the browser session.
  • optimization and increase in the efficiency of the services provided by the Administrator.
  • implementation of processes necessary for the full functionality of the web pages, adapting the content of the Service’s web pages to the User’s preferences and optimizing the use of the Service’s web pages. In particular, these files allow for the recognition of the basic parameters of the User’s Device and the appropriate display of the website, adjusted to their individual needs;
  • correct operation of the affiliate program, enabling in particular the verification of the sources of Users’ redirection to the Service’s websites.
  • remembering the user’s location, correct configuration of selected Service functions, enabling in particular the adjustment of the information provided to the User, taking into account their location.
  • analyses and research and audience audit, creating anonymous statistics that help understand how the Service Users use the Service’s websites, which enables the improvement of their structure and content;
  • providing advertising services, adjusting the advertisements of third-party services and products presented via the Service;
  • ensuring the security and reliability of the service

The Service Administrator uses External Cookies for the following purposes:

  • presenting multimedia content on the Service’s web pages, which are downloaded from an external website,
  • collecting general and anonymous static data using analytical tools:
    • Google Analytics,
    • presenting advertisements tailored to the User’s preferences using an online advertising tool,
    • logging into the service using a social networking site,
    • using interactive functions to popularize the service using the Facebook.com social networking site.
  • presenting opinions on the Service’s web pages, which are downloaded from an external website: using functions to facilitate communication via the Service’s web page, which are downloaded from an external website.

IV. Possibilities of specifying the conditions for storing or accessing Cookies:

The User may independently and at any time change the settings for Cookies, specifying the conditions for their storage and accessing Cookies to the User’s Device. The User may change the settings referred to in the previous sentence using the web browser settings or by configuring the service. These settings may be changed in particular in such a way as to block the automatic handling of Cookies in the web browser settings or to inform about each time Cookies are placed on the User’s device. Detailed information on the possibilities and methods of handling Cookies is available in the software (web browser) settings.

The User may delete Cookies at any time using the available functions in the web browser they use.

Restricting the use of Cookies may affect some of the functionalities available on the Service’s website.

V. Personal data collected on the website

The administrator of your personal data is SANTE Sp. z o. o. with its registered office in Warsaw (03-301), at ul. Jagiellońska 55A, registered in the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division under KRS number 0000050433, NIP: 5241006610, REGON: 010827252.

The Administrator has appointed a Data Protection Inspector, who can be contacted by e-mail: iod@sante.pl

When using the website, we may process personal data of users, such as:

  1. Name and surname,
  2. Telephone number
  3. E-mail address
  4. Correspondence address.

Personal data are processed by employees and associates of the Administrator based on granted authorizations. Each person who has been permitted to process personal data has been familiarized with the principles of personal data protection and has undertaken to maintain the confidentiality of the information provided.

Personal data may be entrusted to an external entity that supports the Administrator in achieving the purposes of processing. The Administrator uses the services of only professional entities that guarantee the provision of services at the highest level and ensure the security of the information entrusted.

VI. Purpose of personal data processing

  1. The Administrator provides the following Electronic Services:
    1. Account,
    2. Order without registration,
    3. Newsletter,
    4. Online reservation,
    5. Contact form.
  2. Orders placed in the Studio Sante store are fulfilled via the domain https://www.sklep.studiosante.pl
  3. The Account electronic service is provided for the Customer to manage their data enabling the use of the Account and Orders placed in the Store.
  4. In the Registration Form, in order to create an Account, the Customer must provide the following data: e-mail address, password, first name, last name, city, postal code, street, house and apartment number (if applicable), mobile or landline number. In the case of Customers who are not Consumers, it is also necessary to provide the company name and Tax Identification Number.
  5. The Account may be used after the Customer completes the Registration Form, expresses the mandatory consents and submits the mandatory declarations, including by clicking the “Register” field.
  6. The Account electronic service is provided for an indefinite period, free of charge.
  7. The Customer may resign from the Account electronic service by sending an appropriate request to the Administrator:

  8. The Order without registration electronic service is provided for the purpose of placing an Order without the need to register an Account. In order to use the Order without registration service, the Customer must provide the following data: first name, last name, city, postal code, street, house and apartment number (if applicable), e-mail address, contact telephone number. In the case of Customers who are not Consumers, it is also necessary to provide the company name and Tax Identification Number.
  9. The Order without registration electronic service is a one-time service and is provided free of charge. The provision of the Electronic Service ends when the Order is completed via the Store or when the Customer stops placing it.
  10. The use of the Newsletter Electronic Service is made by submitting a declaration of willingness to use this Service when creating an Account or placing an Order without registration. The Customer is subscribed to the Newsletter service at the moment of creating an Account or placing an Order without registration. The Customer may use the Newsletter service if they enter their e-mail address in the designated place. The Newsletter Electronic Service is provided free of charge for an indefinite period. The Customer may, at any time and without giving a reason, resign from the Newsletter Service by sending an appropriate request to the Service Provider:

  11. The personal data of the Client of Studio Sante are processed in connection with the appointment and implementation of the treatment. In each case, the Client is informed about the purpose of processing personal data.
  12. The Client can book treatments at Studio Sante online. For this purpose, after selecting the treatment, he will be transferred to the website https://www.moment.pl/, which is administered by Versum limited liability company.
  13. Providing personal data for the purpose of sending commercial information to the specified e-mail address and subscribing to the Newsletter is voluntary. Providing personal data for the purpose of registering in the Store is voluntary. The legal basis for the processing of personal data is the consent granted by the Customer. The processing of personal data for the purpose of purchasing Goods is voluntary, although necessary for the proper implementation of Sales Agreements concluded via the Store. Providing personal data for the purpose of using the contact form is voluntary, but necessary in order to answer your question. If you do not want to provide your personal data, please contact the Administrator by phone.
  14. Processing personal data for the purpose of online booking is voluntary, although necessary for the proper implementation of the service.
  15. The legal basis for the processing of personal data by the Administrator is:
    1. 6 sec. 1 letter a GDPR, i.e. the consent obtained to the processing of personal data;
    2. 6 sec. 1 letter b GDPR, i.e. the performance of the contract or taking action on requests before entering into the contract;
    3. 6 sec. 1 letter c GDPR, i.e. the fulfillment of a legal obligation incumbent on the Administrator.
    4. 6 sec. 1 letter f GDPR, i.e. the legal interest of the Administrator.

VII. Principles and time of processing personal data

  1. The Client’s personal data will be processed until the consent is withdrawn and in connection with the Administrator’s business activity, until the time specified in the provisions of law.
  2. The Client has the right to access the content of their data and to correct, delete, limit processing, the right to transfer data, the right to object. The Client has the right to lodge a complaint with the supervisory body – the President of the Personal Data Protection Office, when they consider that the processing of their personal data violates the provisions of the general regulation on the protection of personal data of 27 April 2016. The personal data provided will not be transferred to a third country. Personal data will not be processed in an automated manner, including in the form of profiling.
  3. In connection with the execution of electronic transactions, the personal data of Customers, which are necessary for the execution of online payments, will be made available to the Bank. From the date of transfer, the administrator of this personal data will be the Bank. The current and available payment methods in the Store are specified on the Store’s website. Possible payment methods are:
    1. Electronic payments via the PayU service.
    2. Cash on delivery: payment must be made in cash upon receipt of the goods.
    3. Payment by traditional transfer to the Seller’s bank account..
  4. In connection with the implementation of the online purchase service, the personal data of the Customers will be transferred to the carrier, who will become the administrator of personal data. This information will be processed solely for the purpose of providing the service.
  5. The Seller provides the following methods of delivery of the Goods:
    1. Courier parcel, courier parcel cash on delivery via the UPS Courier Company.
    2. Parcel locker shipment via Inpost parcel lockers.
    3. Personal collection at the Seller’s office.
  6. In connection with the implementation of the online booking service, the Customer is transferred to the website https://www.moment.pl/, which is administered by Versum limited liability company. The information provided will be processed for the purpose designated by the administrator.
